Electronic Communications Notice

If we send you any legally required debt collection disclosures electronically, we do so in a way reasonably expected to provide actual notice and, in a form, you can keep, consistent with 12 C.F.R. §1006.42 (Regulation F).

California

Licensed by the California Department of Financial Protection and Innovation under License No. CA-2015071.

The state Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act require that, except under unusual circumstances, collectors may not contact you before 8:00 a.m. or after 9:00 p.m. They may not harass you by using threats of violence or arrest or by using obscene language. Collectors may not use false or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work.

California Privacy Rights: The CPRA gives California consumers the right to opt out of the sale of their personal information. Carmel Servicing does not sell or share your personal information.

Colorado

A consumer has the right to request in writing that a debt collector or collection agency cease further communication with the consumer. A written request to cease communication will not prohibit the debt collector or collection agency from taking any other action authorized by law to collect the debt.

Massachusetts

NOTICE: Massachusetts law prohibits a debt collector from making more than two telephone calls to a debtor within a seven-day period regarding a particular debt (940 CMR 7.04).

NOTICE OF IMPORTANT RIGHTS: You have the right to make a written or oral request that telephone calls regarding your debt be made to you at your place of employment. Any such oral request will be valid for only ten days unless you provide written confirmation of the request postmarked or delivered within seven days of such request. You may terminate this request by writing to the debt collector.

North Dakota

Nevada

Medical Accounts Notice: Pursuant to Nevada law, if you pay or agree to pay the debt or any portion of the debt, the payment or agreement to pay: (1) may be construed as an acknowledgement of the debt by you; (2) does not constitute a waiver by you of any applicable statute of limitations set forth in NRS 11.190 that otherwise precludes the collection of the debt. If you do not understand or have questions concerning your legal rights or obligations relating to that debt(s), you should seek legal advice.

60-Day Medical Debt Notice (SB 248; NRS 649.366): No action to collect a medical debt will occur before the 60-day notice period expires.

Special acknowledgment / statute-of-limitations warnings apply to hospital accounts after the period (NRS 649.332(2)).

New York City

Notice for New York City Residents: The New York City Department of Consumer and Worker Protection (DCWP), formerly the Department of Consumer Affairs (DCA), requires us to ask for your language preference for reporting purposes. If you wish to share your preference, send us an email or contact our office by phone.

All communications are in English with the following exception, which may vary by creditor: Spanish-speaking agents are available by phone upon request, and other telephone translations may be available through Language Line Solutions, a third-party service provider. Written communications may be available in Spanish upon request.

We follow NYC DCWP's debt collection rules, including limits on contact attempts and your right to dispute a debt at any time.

In addition to any practices prohibited under any federal, state or local law, a debt collection agency shall not contact a consumer about or seek to collect a debt on which the statute of limitations for initiating legal action has expired unless such agency first provides the consumer such information about the consumer's legal rights as the commissioner prescribes by rule.
